1. Acceptance of Terms

By accessing or using Mindemy ("the Platform"), you confirm that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree, please do not use the Platform.

These Terms constitute a legally binding agreement between you and Mindemy, operated from Romania, European Union. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

You must be at least 16 years old to use Mindemy. By registering, you confirm that you meet this age requirement.

2. Service Description

Mindemy is an online educational platform that provides structured, practical lessons covering a range of AI tools. The course consists of 18 sequential lessons, each focused on a specific AI tool or workflow. Lessons include text content, practical exercises, and knowledge-check quizzes.

Access to lesson content (beyond the first lesson) requires a paid Lifetime Access plan. We reserve the right to modify, update, add, or remove course content at any time to ensure accuracy and relevance. Material improvements to the course content will not reduce the overall value or scope of the course.

We do not guarantee any specific learning outcomes, career results, or earnings as a result of completing the course.

3. Account Registration

To access Mindemy you must create an account by providing your name, email address, and a password. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate and current.
• Keep your password confidential and not share your account credentials with any third party.
• Notify us immediately at support@mindemy.io if you suspect unauthorised access to your account.
• Not create more than one account per person.

You are responsible for all activity that occurs under your account. Mindemy will not be liable for any loss or damage arising from your failure to maintain the security of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or where we detect abuse of the Platform.

4. Lifetime Access & Payments

What "Lifetime Access" Means

A Lifetime Access purchase grants you permanent, personal access to all 18 AI tool lessons available on the Platform at the time of purchase, as well as any future lessons or content updates added to the same course. "Lifetime" refers to the operational lifetime of the Mindemy platform.

Payments

All payments are processed securely by Stripe. By purchasing Lifetime Access, you authorise a one-time charge to your selected payment method. Prices are displayed in Euros (EUR) inclusive of any applicable taxes where required by law.

Access to Content

Lessons are unlocked sequentially — you must complete each lesson before the next is made available. This is a design feature of the learning path, not a limitation of your access rights.

Account Sharing

Your Lifetime Access is personal and non-transferable. Sharing your account credentials or allowing others to access your account is strictly prohibited and may result in immediate suspension without refund.

5. User Obligations & Prohibited Conduct

You agree to use Mindemy only for lawful purposes and in accordance with these Terms. You must not:

• Copy, reproduce, distribute, publicly display, or create derivative works of any course content without our prior written consent.
• Share or resell access to the Platform or any course materials.
• Use automated tools, bots, scrapers, or scripts to access, crawl, or download content from the Platform.
• Attempt to gain unauthorised access to any part of the Platform, its servers, or related systems.
• Upload or transmit viruses, malware, or any other harmful code.
• Engage in any activity that disrupts, overloads, or impairs the Platform's infrastructure.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Attempt to circumvent or reverse-engineer any security or access-control feature of the Platform.
• Use the Platform for any unlawful, fraudulent, or abusive purpose.

Breach of these obligations may result in immediate suspension or termination of your account, without refund and without prejudice to any legal remedies available to us.

6. Intellectual Property

All content on the Mindemy Platform — including but not limited to lesson text, quiz questions, images, graphics, branding, layout, and code — is owned by or licensed to Mindemy and is protected by copyright, trademark, and other intellectual property laws.

By purchasing Lifetime Access, we grant you a limited, non-exclusive, non-transferable, personal licence to access and use the course content for your own private, non-commercial educational purposes only. This licence does not permit you to reproduce, share, publish, or commercialise any part of the content.

Any feedback or suggestions you provide to us may be used by Mindemy without obligation or compensation to you.

7. Third-Party Services

The Platform integrates with third-party services including Stripe (payments) and Resend (email). Your use of those services is subject to their respective terms and privacy policies. Mindemy is not responsible for the acts or omissions of these third-party providers.

The AI tools discussed in the course content are products of third parties. We have no commercial relationship with those tool providers, and their pricing, availability, and features may change independently of our course content. Mindemy is not affiliated with, endorsed by, or sponsored by any of the AI tool providers featured in the course.

8. Disclaimers

The Platform and all course content are provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Platform will be uninterrupted, error-free, or free from viruses or harmful components.
• The course content is complete, accurate, or up to date at all times (though we endeavour to keep it current).
• The use of any AI tool or technique described in the course will produce any particular result for you.

Nothing in these Terms excludes or limits any statutory rights you may have as a consumer under applicable Romanian or EU law that cannot be excluded by contract.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Mindemy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of the Platform.

In any event, our total aggregate liability to you for any claim arising under or in connection with these Terms shall not exceed the total amount paid by you to Mindemy in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

10. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

If you are a consumer resident in another EU member state, you retain any mandatory consumer protection rights granted by the laws of your country of residence.

Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of Romania, unless mandatory consumer protection rules of your country of residence apply.

Under EU Regulation No. 524/2013, EU consumers may also use the EU Online Dispute Resolution (ODR) platform to resolve disputes. Our email for ODR purposes is support@mindemy.io.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, technology, or applicable law. For material changes, we will notify registered users by email at least 30 days before the changes take effect. The updated Terms will be posted at this URL with an updated effective date.

If you continue to use the Platform after the effective date of any change, you are deemed to have accepted the updated Terms. If you do not agree to the updated Terms, you should stop using the Platform and, if eligible, request a refund in accordance with our Refund Policy.
